11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services ("Dispute"), you agree to first attempt to resolve the Dispute informally by contacting Wing Snob at [email protected]. Wing Snob will attempt to resolve the Dispute informally within thirty (30) days of receipt of your notice. If the Dispute is not resolved within this period, either party may proceed to formal dispute resolution as described below.

11.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND CONTAINS AN AGREEMENT TO ARBITRATE, WHICH WILL, WITH LIMITED EXCEPTIONS, REQUIRE YOU TO SUBMIT CLAIMS YOU HAVE AGAINST WING SNOB TO BINDING AND FINAL ARBITRATION.

Except for Disputes that qualify for small claims court, any Dispute that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in English and shall take place in the United States at a location mutually agreed upon by the parties, or via remote means where permitted. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND WING SNOB AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. Unless both you and Wing Snob agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding.

11.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court of competent jurisdiction in lieu of arbitration, provided that the claim qualifies for such court under applicable law.

11.5 Waiver of Jury Trial

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WING SNOB EACH WAIVE ANY CONSTITUTIONAL OR STATUTORY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS.

12. Term and Termination

12.1 Term

These Terms shall remain in full force and effect while you use our Services or maintain an account with Wing Snob. Certain provisions of these Terms, by their nature, shall survive termination, including but not limited to provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

12.2 Termination by You
